This website is owned and operated by Colorado Traders, a New Zealand registered and owned company having its registered office at 262 Thorndon Quay, Pipitea, Wellington 6011. By accessing and/or using this website you accept these terms and conditions. We may amend these terms and conditions from time to time. If we make amendments we will publish the amended terms and conditions on this website. Your continued use of the website after such amendment will constitute your acceptance of the amendments.
All prices in are in New Zealand currency and include GST. Prices can be viewed in AUD, CAD, EUR, GBP or USD. However, these converted prices are approximate and the exact conversion may differ according o the relevant exchange rate at the time of purchase. Charges will be made in New Zealand dollars and converted to the relevant currency at the time of charging. All prices are correct at time of publication. However, we reserve the right to alter prices at any time.
We accept American Express, MasterCard and Visa as payment through our website, as well as transfers via PayPal. Our checkout pages are securely served and encrypted using SSL. Credit Cards are verified in real time using the DPS Payment Express Payment Gateway. The name that will appear on your statement will be On Mountain Ltd.
Your credit card details do not get processed or transmitted through our website; all transactions are processed via a totally secure payment service provider. We use the DPS Payment Express Payment Gateway to provide this service and to host and manage the payments page. All transaction sessions are stored and processed in encrypted strings. Your credit card details are not held by us and cannot be accessed by our staff.
We use Courier Post’s overnight delivery service for delivery within New Zealand. Delivery will normally take place 2-3 business days after you place your order except for Rural Delivery customers who should allow 3-5 business days for delivery.
We recommend that you give us an address where someone will be able to sign for the delivery. Deliveries normally occur between 8am and 5pm Monday to Friday. If no one is home, a card will be left with instructions on how to obtain your parcel.
We are happy to deliver to an office/business address, but make sure you give us the full address including the company name and level we need to deliver to.
PO Box delivery is available for New Zealand customers.
We must have correct and complete addresses, including a company name where necessary, and at least one contact telephone number.
Once your order has been dispatched you will receive an email with a tracking reference. Please note the number might not be traceable straight away.
Go to http://www.courierpost.co.nz/ for New Zealand orders to follow the journey of your parcel. You will be able to see the status of your order if you log in to the website.
For deliveries outside New Zealand we use New Zealand Post's International Air service. The cost of delivery will be calculated according to the weight of your parcel. You should allow 5 – 7 business days for delivery to Australia and 7 – 10 working days for delivery to the rest of the world. PO Box delivery is not available outside New Zealand.
While we will always endeavour to send your order within the quickest time-frame possible, we cannot guarantee delivery times.
All orders are sold and delivered from New Zealand. Orders delivered outside New Zealand may require you to pay import duties and taxes; if so you will be charged once your parcel has reached your country. Unfortunately we have no control over these charges. If you have any questions related to customs charges you are advised to contact your local customs office.
If you have ordered online from us only to find the item(s) do not fit, we will exchange the size (subject to availability) or refund the purchase price via your original form of payment once the goods have been returned to us in satisfactory condition. The returned item(s) must be unworn and unmarked and returned to us within 7 days of receipt. You must meet the cost of shipping the goods back to us.
If you wish to make an exchange please do the following:
- To speed up the returns process, we suggest that you notify us by email that you are returning or wish to exchange your order and detail the new size(s) you would prefer.
- Package your item(s) carefully and return using a tracked delivery system.
- Please print out a copy of your email to us regarding the exchange and place it in the parcel.
- For your protection, we advise that you return items via courier or registered mail. Please retain your postage receipt for tracking details. Send returns to:

6. REFUNDS, REPAIRS & REPLACEMENTS
Refunds, repairs or replacements will be given in cases of defective goods. Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund, repair or replacement. If a replacement, repair or same value store credit can be given, that will be the preferred course of action.
If you are approved for refund, your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 10 working days. If you have not received your refund within the 10 working days specified please contact your credit card company and/or bank. It may take some time before your refund is officially posted.
We guarantee all of our products against manufacturing and material faults. This guarantee is applicable for the fair and reasonable life of the garment. If issues arrive through general wear and tear, the garment will be assessed as per clause 6 above.
8. INTELLECTUAL PROPERTY
Unless otherwise stated, this website and its contents are subject to copyright. You may use, copy and print parts of this website solely for your personal, non-commercial use. Except as permitted by the Copyright Act you must not reproduce, distribute, modify, display or publish this website or any of its contents, without our prior written consent.
The website contains trademarks. The use and reproduction of these trademarks is strictly prohibited without our prior written consent.
9. LIMITATION OF LIABILITY
Except to the extent of written warranties given by us to you, all warranties and representations in respect of goods sold or services supplied are excluded, including (to the extent permitted by law) those expressed or implied by law.
Our total liability under any warranty for defective or damaged goods supplied by us, or in relation to services is limited at our option to either;
a) replacing or repairing the defective or damaged goods; or
b) refunding the price of the defective or damaged goods.
Any goods returned to us must be returned freight paid. You can claim for any reasonable freight charges for defective or damaged goods. Where we elect to repair defective goods, we will use all reasonable endeavours to repair the goods as soon as possible, but will not be liable for any delay in completing the repairs.
If the Consumer Guarantees Act (CGA) applies, these terms and conditions shall be read subject to your rights under the CGA provided that if you are acquiring goods or services for business purposes the CGA shall not apply.
Unless expressly agreed in these terms and conditions neither the owner of this website nor its affiliates, directors, officers, employees, agents, contractors, successors or assignees will be liable for any damages whatsoever arising out of, or in any way related to, the use of this website and any third party websites linked to this website. This limitation applies to direct, indirect, consequential, special, and punitive or other damages you or others may suffer, as well as damages for loss of profits, business interruption or the loss of data or information.
We cannot guarantee that any file or program available for download and/or execution from or via this website is free from viruses or other conditions which could damage or interfere with data, hardware or software with which it might be used. You assume all risk of use of all programs and files on this website, and you release us entirely from all responsibility for any consequences of its use.
10. GOVERNING LAW
These terms and conditions will be interpreted in accordance with and governed by the laws of New Zealand and the New Zealand courts will have exclusive jurisdiction in respect of any dispute.
